1. Agreement and Scope
Welcome to OMARA Cosmetics. These Website Terms of Use ("Terms") govern access to and use of https://omaraskin.com and related website features (the "Site") operated by OMARA Cosmetics LLC ("OMARA," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site. Additional terms may apply to purchases, promotions, and the referral program; where those terms conflict for a specific activity, the specific terms control.
2. Eligibility and Acceptable Use
The Site is intended for people who can lawfully use it. If you are under the age of majority where you live, use the Site only with appropriate parental or guardian involvement. 4. Waitlist and Email Communications
Joining the OMARA waitlist does not constitute a purchase, reservation, or guarantee of early access or product availability. When you affirmatively subscribe to marketing emails, you may receive brand news, launch announcements, offers, and related updates as disclosed at signup. You may unsubscribe using the link in marketing emails. Operational messages may still be sent when appropriate. Our Privacy Policy describes how we handle personal information.
5. Referral Program
Participation in any OMARA referral program is governed by our separate Referral Program Terms and Conditions, which explain qualifying referrals, milestone eligibility, restrictions, and reward limitations. A waitlist subscription alone does not require referral participation. We may address suspicious, fraudulent, or abusive activity consistent with those terms and applicable law.
6. Intellectual Property
The OMARA name, logos, designs, product names, artwork, photographs, website text, and other Site content are owned by OMARA or used with permission, and may be protected by intellectual property laws. You may use the Site for personal, noncommercial purposes. You may not copy, reproduce, modify, distribute, or commercially exploit Site content without permission, except as permitted by law. No trademark license is granted by your use of the Site.
7. User Submissions and Feedback
If you send feedback, suggestions, reviews, or other content, you represent that you have the right to provide it and that it does not violate others' rights or applicable law. You grant OMARA a nonexclusive, worldwide, royalty-free license to use, reproduce, and display submissions for operating and improving our business, subject to applicable privacy laws and any separate permissions required for marketing use of your name, image, or likeness. Do not send confidential ideas unless we have separately agreed in writing.
8. Product and Skincare Information
Content on the Site is for general informational purposes and is not individualized medical advice, diagnosis, or treatment. Skincare experiences vary. Follow product instructions and warnings; discontinue use and seek appropriate professional advice if you experience an adverse reaction. Product-specific labels and legally required warnings control over general website descriptions. Nothing in these Terms limits rights or remedies that cannot lawfully be waived.

To the extent permitted by applicable law, the Site is provided on an "as available" basis, without warranties concerning uninterrupted operation or error-free content. We do not disclaim any warranty, representation, or consumer right that cannot lawfully be excluded. These disclaimers do not replace any warranties or obligations applicable to products sold by OMARA.
12. Limitation of Liability
To the extent permitted by applicable law, OMARA will not be liable for indirect, incidental, special, or consequential damages arising solely from use of the Site. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, personal injury, defective products, or other liability that cannot legally be limited. Applicable consumer protection laws remain in effect.
